ART FUGACE processes the personal data of the users in order to allow them to browse through artfugace.com and in order to allow them to contact ART FUGACE, also by means of specific forms.

Browsing data

The information systems and software procedures relied upon to operate artfugace.com acquire personal data as part of their standard functioning; the transmission of such data is an inherent feature of Internet communication protocols.
This data category includes the IP addresses and/or the domain names of the computers and terminal equipment used by any user and other parameters related to the user's operating system and computer environment.
These data are necessary to use web-based services and are also processed in order to
extract statistical information on service usage (most visited pages, visitors by time/date, geographical areas of origin, etc.);

Sending messages, on the basis of the user’s free, voluntary, explicit choice, to ART FUGACE contact addresses, or sending private messages to ART FUGACE social media pages and profiles (where this option is available), and filling in and sending the forms made available on artfugace.com entail the acquisition of the sender’s contact information – which is necessary to provide a reply – as well as of any and all the personal data communicated in that manner.

Cookies and other tracking devices

No user profiling cookies are used. The only processing operation we perform is related to the creation of statistics via pseudonymised data concerning navigation on artfugace.com.
Based on the implemented configuration, which does not rely on identifying information, the following data are collected:

1. IP address, which is masked by setting the final 2 bytes to ‘0’ (xxx.xxx.0.0)
2. Operating system
   Browser type
3. Device type (PC, smartphone, etc.)
4. Non-persistent session cookies are used as strictly necessary to allow secure, efficient navigation.

Legal basis for the processing

The processing of users' personal data carried out in order to allow navigation within artfugace.com are carried out on the basis of a legitimate interest of ART FUGACE aimed at making it possible for users to use the site and guaranteeing the satisfaction of their expectations.

The processing of personal data carried out to allow users to contact ART FUGACE is optional and is based on users’ consent.

Data recipients

Personal data – which will not be disseminated – may however be communicated to:

ART FUGACE employees or collaborators that are located within the European Union;

• obtain the limitation of the processing of personal data, pursuant to Article 18 of the Regulation;
• oppose the processing of personal data, within the limits set out in the Regulation, where applicable;
• receive in a structured format, commonly used and readable by an automatic device, the personal data concerning him and that have been provided by him, also in order to transmit such personal data to another data controller, in the cases and within the limits specified to Article 20 of the Regulation, where applicable.

Without prejudice to any other administrative or judicial appeal, the user will also have the right to file a complaint to the competent Supervisory Authority (for the contacts of the Supervisory Authority of his jurisdiction, please visit this link if it considers that the data processing is carried out in violation of the Regulation.

SOCIAL MEDIA POLICY

ART FUGACE uses social media and messaging services for communication purposes, and in particular to raise awareness of NFTs and art culture as well as to gather contributions and comments, queries and suggestions.
ART FUGACE official social media and messaging services are listed below:

Any other social media or messaging profiles that purport to be from ART FUGACE are not handled by ART FUGACE or are traced back to it.

Users on ART FUGACE’s social channels are expected to follow a few, simple key rules:

• Express their views politely, precisely, respectfully, and by using appropriate language. No abuse, profanities, threats or violent or defaming attitudes or behavior will be tolerated. Everyone shall be liable, also under the law, for the contents they post and the opinions they provide.
• When presenting data, news or opinions on specific issues or facts, users have to provide substantiated rather than vague arguments and quote reliable, verifiable sources.
• Public contents shall always respect an individual’s private sphere. Please refrain from mentioning facts or details that are of no public interest and may affect a third party’s personal sphere.

Ads, spam, and promoting private interests as well as lawful or unlawful activities are not permitted.
Contents in breach of copyright and the unauthorized use of registered trademarks are not permitted.

Whenever possible, all posts, comments and audio/video materials will be removed by the staff if:

• They include inappropriate language and/or are framed in a threatening, violent, vulgar or abusive manner;
• They include contents that are illicit or incite to the commission of illicit activities;
• They are intended to promote products or services;
• They disclose, directly or indirectly, personal data and information such as names, email accounts, phone numbers, Tax IDs, bank account information, addresses, registration numbers for documents or case files, videos or pictures of identifiable individuals, etc., or else data and information that may in any way cause harm to or undermine the privacy or reputation of the data subjects;
• They report, directly or indirectly, information relating to children;
• They include discriminatory contents in terms of gender, race, ethnicity, language, religious beliefs, political opinions, sexual orientation, age, personal and social conditions, health;
• They are intended as spam;
  They foster or support lawful or illicit activities that are in breach of copyright or use registered trademarks inappropriately;
• They are in general inconsistent with the purposes of ART FUGACE’s official communications and the contents of its social profiles (off-topic rule).

In case any of the above rules is not complied with, ART FUGACE reserves the right to ban or block the contents in question (if feasible, after an initial warning) and to report the user to the platform operators and the competent authorities in the most serious cases – e.g., if illicit activities are promoted or supported, or any type of offense is committed or harm is caused to third parties.

Followers of ART FUGACE’s social media channels are not automatically followed.

Users’ personal data are processed in accordance with the policies available on artfugace.com.

Personal data included in public comments or posts within ART FUGACE’s social media channels may be removed. Any data that is shared by users via private messages sent directly to the managers of the individual channels will be processed in compliance with the applicable personal data protection legislation and in line with the information notice on ART FUGACE’s website.
